By accessing or using the website located at clevelandconcretecompany.com or by engaging the services of Cleveland Concrete Company ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, do not use our website or services.
These Terms and Conditions apply to all visitors to our website and to all customers who engage us for concrete contracting services.
Cleveland Concrete Company is a concrete contracting company based in Cleveland, TN. We provide concrete installation, construction, and related services to residential and commercial customers. Our services include, but are not limited to, concrete driveways, patios, sidewalks, foundations, floors, retaining walls, pool decks, steps, and concrete cutting.
All services are subject to the availability of our crew, site conditions, weather, material availability, and applicable local permits. We reserve the right to decline any project at our discretion.
All estimates provided by Cleveland Concrete Company are written and itemized. An estimate is not a binding contract. Final pricing is established in a written agreement signed by both parties before work begins.
Estimates are based on the information available at the time of the site visit. If unforeseen site conditions are discovered after work begins - such as unstable soil, buried debris, or underground utilities - we will notify you before proceeding with any work that would change the scope or cost. You will have the opportunity to approve or decline the additional work.
Prices are subject to change due to fluctuations in material costs. We will notify you of any material price increases before they affect your project.
Project scheduling is confirmed in writing once a deposit or signed agreement is received. Start dates are estimates and may shift due to weather, permit delays, or prior project timelines. We will communicate any schedule changes as promptly as possible.
If you need to cancel a scheduled project, please notify us at least 48 hours in advance. Cancellations with less than 48 hours notice may result in forfeiture of any deposit paid to secure your scheduling date, at our discretion.
We reserve the right to suspend or reschedule work due to unsafe weather conditions, including extreme heat, freezing temperatures, heavy rain, or any conditions that would compromise the quality of the concrete installation.
Payment terms are outlined in the written agreement for each project. In general, a deposit is required to secure your project start date, with the remaining balance due upon project completion unless otherwise agreed in writing.
Accepted payment methods are specified in your written agreement. Invoices not paid within the agreed timeframe may be subject to a late fee as specified in your agreement.
If payment is not received and we are required to pursue collection, you agree to be responsible for any reasonable costs of collection, including attorney fees, to the extent permitted by applicable law.
We will obtain all permits required by the relevant local authority for work performed on your property, unless otherwise agreed in writing. Permit fees, when applicable, are the responsibility of the customer and will be disclosed in your written estimate. You agree to allow us reasonable access to your property to complete permit-required inspections.
We stand behind the quality of our workmanship. Any specific warranty terms will be stated in your written project agreement.
Concrete is a natural material subject to cracking, color variation, and surface changes over time, particularly in climates with freeze-thaw cycles, heavy rainfall, or clay soil conditions like those common in Cleveland, TN. Minor cracking and surface variation are characteristics of the material and are not considered defects in workmanship.
Warranty coverage does not apply to damage caused by customer misuse, improper maintenance, de-icing salts, vehicle loads exceeding the designed capacity, acts of nature, or modifications made by parties other than Cleveland Concrete Company.
Except as stated in a written warranty, our services are provided "as is." We make no other express or implied warranties, including any implied warranty of merchantability or fitness for a particular purpose, to the fullest extent permitted by applicable law.
To the fullest extent permitted by applicable law, Cleveland Concrete Company shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to our services or your use of our website.
Our total liability to you for any claim arising out of or related to a specific project shall not exceed the total amount you paid us for that project. This limitation applies regardless of the basis of the claim, including contract, tort, statute, or any other legal theory.
The content on our website is provided for general informational purposes only. We make no representations or warranties about the accuracy or completeness of the information on this site.
You agree not to use our website for any unlawful purpose or in any way that could damage, disable, or impair the site or interfere with any other party's use of the site.
If a dispute arises between you and Cleveland Concrete Company related to our services or these Terms and Conditions, we encourage you to contact us first to try to resolve the matter directly. Most concerns can be addressed quickly through open communication.
If a dispute cannot be resolved informally, both parties agree to attempt to resolve the matter through non-binding mediation before pursuing any other legal remedy. Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.
These Terms and Conditions and any disputes arising out of or related to them are governed by the laws of the State of Tennessee, without regard to its conflict of law provisions. Any legal proceedings shall be brought in the courts located in Bradley County, Tennessee.
